Can foreigners buy property in Malaysia? The 2026 rules and costs

Malaysia Prime Property · Updated September 2026 · Can I buy?

Yes. Foreigners can buy residential property in Malaysia, including new-launch condominiums, subject to state rules.

  1. Minimum price: the minimum purchase price for foreigners is generally RM1mil in Kuala Lumpur and RM2mil in Selangor.
  2. Approval: each foreign purchase needs approval from the land authority before the title can be transferred.
  3. Stamp duty: from 1 January 2026, foreign buyers pay a flat 8% on residential transfers, while Malaysians pay on a 1–4% scale.
  4. Financing: Malaysian banks usually lend foreigners 60–80% of the price, which means a foreign buyer needs a larger cash payment.
  5. Before you book: foreign buyer rules change from time to time, which is why your lawyer should confirm the current position.

What is the minimum price for foreign buyers in each state?

The minimum price for foreign buyers is generally RM1mil in Kuala Lumpur and RM2mil in Selangor.

StateMinimum price
Kuala LumpurRM1mil
SelangorRM2mil
  1. Other states: each state sets its own minimum, which is why your lawyer should confirm the figure for the home you like.
  2. Exceptions: a state can change its minimum or set a different figure for some homes.

How much cash does a foreign buyer need upfront?

Common questions

Do foreigners pay tax when they sell?

Yes. Foreign sellers pay real property gains tax (RPGT), and the rate depends on how long you hold the home. Ask your lawyer for the current rate.

Can foreigners buy under their company’s name?

Yes, in many cases, but a foreign-owned company follows the same minimum price and approval rules. Take legal advice on the structure first.

Can foreigners buy freehold property in Malaysia?

Yes. Foreigners can buy freehold property, subject to the same minimum price and approval rules.

Do I need MM2H to buy property in Malaysia?

No. MM2H is a residence programme and isn’t required to buy property. It has its own property rules if you join it.

Can I rent the unit out?

Generally yes, subject to the building’s house rules and the sale agreement. Ask us before you book.
