A Malaysian buyer with a 90% loan pays about RM50,000 in stamp duty and legal fees on a RM1mil new launch.
- Stamp duty: Malaysians pay 1–4% on the transfer and foreigners pay a flat 8%, plus 0.5% on the loan agreement.
- Legal fees: your lawyer charges once on the sale agreement (SPA) and once on the loan agreement.
- Developer packages: some developers pay the legal fees and some don’t. Our figures assume you pay them, which means a package can only bring your cost down.

How are stamp duty and legal fees calculated?
Stamp duty follows the Stamp Act scale, and legal fees follow the Solicitors’ Remuneration Order 2023.
- Stamp duty on the transfer (MOT): Malaysians pay 1% on the first RM100,000, 2% on the next RM400,000, 3% on the next RM500,000 and 4% above RM1mil.
- Stamp duty on the loan agreement: the rate is 0.5% of the loan amount.
- Legal fees on the SPA: the scale is 1.25% of the first RM500,000 and 1% of the next RM7 million.
- Legal fees on the loan agreement: the same scale applies, on the loan amount.
- First-home exemption: Malaysian citizens buying a first home up to RM500,000 are exempt from both stamp duties for sale agreements signed up to 31 December 2027. Budget 2027 proposes to widen this: see our Budget 2027 guide.
When do you pay stamp duty and legal fees on a new launch?
You pay the legal fees and the loan stamp duty when you sign, and the transfer stamp duty later, when the title is transferred.
| RM1mil home, 90% loan | Amount |
|---|---|
| Sale agreement: down payment (10%) | RM100,000 |
| Sale agreement: SPA legal fee | RM11,250 |
| Loan agreement: stamp duty and legal fee | RM14,750 |
| Title transfer: transfer stamp duty (MOT) | RM24,000 |
| Cash to plan for | RM150,000 |
- Transfer stamp duty (MOT): on a new launch this is often paid years after booking, which gives you time to set the cash aside.
- The price list: ask us what the developer’s package covers on the unit you like.
