How stamp duty and legal fees are calculated

Total = transfer stamp duty + 0.5% of the loan + legal fee on the price + legal fee on the loan

Transfer stamp duty runs from 1% to 4% for Malaysians, and is a flat 8% for foreign buyers. The legal fee is 1.25% of the first RM500,000 and 1% of the next RM7 million.

Example: a Malaysian buying at RM1mil with a RM900,000 loan pays about RM50,000.

Common questions about stamp duty and legal fees

How is stamp duty calculated in Malaysia?

Malaysians pay 1% on the first RM100,000, 2% on the next RM400,000, 3% on the next RM500,000 and 4% above RM1mil. The loan agreement adds 0.5% of the loan.

How much stamp duty do foreigners pay?

Foreign buyers pay a flat 8% on residential transfers from 1 January 2026, plus 0.5% on the loan agreement.

How are legal fees calculated?

The scale is 1.25% of the first RM500,000 and 1% of the next RM7 million, once on the SPA and once on the loan agreement.

Does this include a developer package?

No. Some developers pay the legal fees and some don’t, which is why the calculator assumes you pay them. A package can only bring the figure down.

Does this include SST and disbursements?

No. Ask your lawyer for a quote on these.

Is a first home exempt?

Malaysian citizens buying a first home up to RM500,000 are exempt from both stamp duties for sale agreements signed up to 31 December 2027. Choose a first-home option in the Buyer box to apply it.

Does the calculator include the Budget 2027 proposal?

Yes, as its own Buyer option for a first home up to RM750,000. It is a proposal, not law, and the Ministry of Finance has not published how the 50% is calculated.
